Welcome to Somari. These Terms of Service ("Terms") govern your access to and use of our mobile application and services. By accessing or using Somari, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our service.

1. Acceptance of Terms

By creating an account or using Somari, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Somari.

2. Eligibility

You must be at least 13 years old to use Somari. By using our service, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use our service.

You retain ownership of the content you upload to Somari, including videos, comments, and profile information ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display your User Content in connection with operating and providing our services.

4.2 Content Standards

You agree that your User Content will not:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Contain hate speech, harassment, or bullying
• Include sexually explicit or pornographic material
• Promote violence or dangerous activities
• Contain spam, malware, or deceptive content
• Impersonate any person or entity
• Violate the privacy rights of others

4.3 Content Moderation

We reserve the right to review, remove, or refuse to display any User Content that violates these Terms or that we deem inappropriate. However, we are not obligated to monitor all User Content.

5. Prohibited Conduct

You agree not to:

• Interfere with or disrupt the service or servers

The Somari app, including its design, features, graphics, and code, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our service without our express written permission.

Our service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites. You access third-party sites at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOMARI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the service
• Any bugs, viruses, or other harmful code that may be transmitted through the service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the service

You agree to indemnify, defend, and hold harmless Somari and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the service, your User Content, or your violation of these Terms.

We reserve the right to suspend or terminate your account and access to the service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the service will immediately cease.

You may terminate your account at any time by contacting us at support@somari.com or through the account settings in the app.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the service after such changes constitutes your acceptance of the new Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration, except where prohibited by law.
